Where does that case land? The appeals court has said he is not immune but if he appeals that case to the Supreme Court or this new situation of taking up the immunity case ..does the civil case die?
Does the law enforcement folks who were really hurt get a middle finger for their injuries by the supreme court? Does the lower courts get a middle finger as well?
Meteor Blades is correct. We need more conversation on this action as it sure can impact a lot ! Not just the criminal case but other cases as well.
In addition to suing Trump, the officers named more than a dozen others as defendants. Among them are members of the far-right extremist groups the Proud Boys and the Oath Keepers, as well as Roger Stone, a longtime Trump ally. The Capitol Police officers sought civil damages for the physical and emotional injuries they said they suffered as a result of the Jan. 6 attack.
Trump asked the federal District Court in Washington to dismiss the case, arguing he is absolutely immune from being sued for the alleged acts. But in January, U.S. District Judge Amit Mehta rejected his argument and allowed the case to proceed.
Mehta applied the same reasoning used in the case filed by the Democratic lawmakers and two police officers. There, he ruled in February 2022 that Trump is not entitled to broad immunity from civil lawsuits seeking to hold him accountable for the Jan. 6 riot.
Referencing Trump's speech outside the White House before the Capitol building was breached, Mehta said the remarks were not part of the president's official duties. Instead, the judge said, Trump's words were "an implicit call for imminent violence or lawlessness" that is not protected by presidential immunity or the First Amendment.
The D.C. Circuit agreed with the lower court's finding and rejected Trump's argument that he was engaging in an official function of the presidency when he spoke outside the White House on Jan. 6.
The lawsuits seek civil damages for harms they say they endured when rioters descended on the Capitol as Congress met to certify Biden’s election victory, smashing windows, engaging in hand-to-hand combat with police officers and sending lawmakers running into hiding. One of the lawsuits, filed by Rep. Eric Swalwell, a Democrat from California, alleges that Trump directly incited the violence at the Capitol “and then watched approvingly as the building was overrun.”
Two other lawsuits were also filed, one by other House Democrats and another by officers James Blassingame and Sidney Hemby, who were both injured in the riot. Blassingame said Friday that he “couldn’t be more committed to pursuing accountability” in the case.
“More than two years later, it is unnerving to hear the same fabrications and dangerous rhetoric that put my life as well as the lives of my fellow officers in danger on January 6, 2021,” he said in a statement. He added: “I hope our case will assist with helping put our democracy back on the right track; making it crystal clear that no person, regardless of title or position of stature, is above the rule of law.”
If they decide he is immune...does this just get thrown to the wind?
I also have a question. What about the people already convicted or plead guilty...does a ruling of immunity give them fodder to yell hostage like Trump is doing?
THIS IS A TOTAL MISCARRIAGE OF JUSTICE FOR THE SUPREME COURT TO TAKE THIS UP….WHY EVEN HAVE APPEAL COURTS? Why bother ?
