It is obvious that Putin is committing war crimes by targeting civilians and creating genocide. From what I have read, International law has provisions and consequences for such acts that are happening in Ukraine. My question , well I have several, is who goes in and takes a person to the Hague and what is the process and why has this not happened yet. It is so obvious he is on a killing spree of complete genocide. Women, Children, disabled, all are targets.
Something has to be done.
The International Criminal Court (ICC)
The International Criminal Court (ICC) investigates and tries individuals charged with the most serious crimes within the context of international criminal law, including war crimes.
The ICC is governed by an international treaty called the Rome Statute, to which 123 countries (including Australia) are States Parties.
The International Criminal Court Act 2002 facilitates Australia’s compliance with its obligations under the Rome Statute, including those relating to the provision of investigative assistance and the arrest and surrender of suspects.
The crimes over which the ICC can exercise jurisdiction under the Rome Statute (which in addition to war crimes include genocide and crimes against humanity) are criminalised under Australia’s domestic law.
The ICC also has jurisdiction over the crime of aggression originating from amendments to the Rome Statute adopted in 2010. Australia has not ratified the 2010 amendments, and therefore the crime of aggression is not criminalised under Australia’s domestic law.
Another question is who goes in and arrests these people?
- The United States is collecting evidence of possible war crimes by Russia during its ongoing invasion of Ukraine, a National Security Council spokesperson said.
- The U.S. is also investigating possible human rights abuses and violations of international law by Russia, the spokesperson said.
- The statement comes as Russia has been widely condemned for the attack on Ukraine, which has included shelling of civilian areas and led to more than 1.5 million refugees fleeing the country.
- “We are appalled by Russia’s brutal tactics and the rising number of innocent civilians who have been killed in Russian strikes, which have reportedly hit schools, hospitals, kindergartens, an orphanage, residential buildings and those fleeing through humanitarian corridors,” the spokesperson said.
There is no possibility to it… Bombing maternity hospitals? They are just killing for the sake of killing.
To me no investigation is necessary. The blood and exodous is in plain view. The only investigation should be video and documentation of what is happening at Putin’s orders.
I really would like to know how and who at Interpol I presume goes after such monsters, Do we have to wait until more innocents and just murdered and it’s over to try these kind of dictators?
Lots of questions on How war crimes are prosecuted and the war criminal is taken into custody.
Carpenter said 45 participating states launched the so-called Moscow Mechanism to document and gather evidence of violations of international law. A report from that inquiry will be presented to the International Criminal Court and the International Court of Justice “so individuals at all levels are held to account,” he said.
“The brutality of this war is both revolting and heartbreaking,” said Carpenter. “Children have been killed, grandparents driven from their homes, families forced to flee their country in the face of relentless strikes on civilian infrastructure.”
The International Criminal Court’s chief prosecutor last week opened an investigation into Russia’s conduct in Ukraine.
“I am satisfied that there is a reasonable basis to believe that both alleged war crimes and crimes against humanity have been committed in Ukraine in relation to the events already assessed during the preliminary examination by the Office,” said the prosecutor, Karim Khan.
